Questions about NCLT, DRT & Insolvency Matters

Common questions we are asked on this practice area. If yours is not covered here, get in touch and we will answer it directly.

The National Company Law Tribunal hears corporate matters including insolvency applications under the Insolvency and Bankruptcy Code, schemes of merger and amalgamation, oppression and mismanagement petitions, and various company law applications. We advise on whether the tribunal is the right forum and on the strength of the case before anything is filed.

Depending on the amount, the nature of the debt and whether it is disputed, the routes include an insolvency application under the IBC, recovery proceedings before the Debts Recovery Tribunal for debts owed to banks and financial institutions, or civil recovery. We assess the documentation supporting the claim first, because that usually determines which route is viable.

Timelines here are short, so the first step is establishing whether the debt is admitted, disputed or already settled, and whether a pre-existing dispute exists on record. We prepare the reply and supporting evidence and represent you at the hearing, while advising in parallel on settlement where that serves you better.

Yes. We prepare and file claims with the resolution professional in the prescribed form with supporting proof, follow up on admission and classification of the claim, and represent creditors in the process including in committee of creditors matters where applicable.
