Yes. A search across the register and common-law use tells you whether the mark is likely to face objection or opposition, and whether someone else already has rights in it. It is far cheaper to discover a conflict before filing than after investing in the brand. We have handled more than 500 trademark applications and advise on distinctiveness and class selection at this stage.

Once filed, the application receives a number that allows use of the TM symbol, then passes through examination, publication in the journal and an opposition period before registration. An unopposed application typically takes many months; an objection or opposition extends it. Registration is valid for ten years and is renewable.

A reply must be filed within the prescribed period setting out why the objection should not stand — commonly addressing similarity with an existing mark or a distinctiveness objection — supported by evidence of use where that helps. We draft the response and appear at the hearing if one is scheduled.
